Terms and conditions of sale

These general terms and conditions govern the sale of products marketed through the StarClean website, available at www.starclean.it.

Submitting an order through the website implies full acceptance of these general terms and conditions of sale.

2. Subject of the contract

These terms regulate the distance sale of products published on the StarClean website and purchased by the Customer through electronic means.

The information contained on the website shall not be considered binding except as expressly provided by applicable law and these terms and conditions.

3. Customers

Purchases may be made by both final consumers and professional customers with VAT registration numbers.

A consumer is a natural person purchasing for purposes unrelated to any business, commercial, craft or professional activity.

A professional customer is a person or entity purchasing within the scope of its business or professional activity.

4. Purchase procedure

The Customer may purchase the products listed in the online catalogue by following the procedure indicated on the website.

Receipt of the order is confirmed by the system through a communication sent to the email address provided by the Customer during registration or purchase.

The confirmation of receipt of the order does not automatically constitute final acceptance of the purchase proposal, which is deemed completed only after verification of product availability and correctness of the information entered.

StarClean reserves the right not to accept incomplete or incorrect orders, or orders relating to products that are unavailable, even partially.

5. Prices

All prices published on the website are expressed in Euro.

Unless otherwise specified, prices are inclusive of VAT. Any shipping costs are indicated separately before the order is completed.

The price charged is the one published on the website at the time the order is submitted.

StarClean reserves the right to change prices at any time, provided that the Customer will be charged the price shown on the website at the time of order confirmation.

6. Product availability

The availability of products indicated on the website is to be considered indicative and not binding, as it may vary due to simultaneous access by multiple users and orders.

If one or more products are found to be unavailable after the order has been placed, StarClean will promptly inform the Customer and, where possible, propose:

  • waiting for restocking;
  • replacement with an equivalent product;
  • full or partial refund of any amounts already paid.

7. Product characteristics

Technical information, descriptions, images, datasheets and documentation published on the website are provided for information purposes only.

For chemical products, detergents, sanitizers and professional-use items, the Customer is required to carefully review the instructions for use, technical documentation and any available safety data sheets.

Images, packaging, labels, colours and formats may be updated by the manufacturer without prior notice.

StarClean shall not be held liable for minor differences between the illustrative image and the product actually delivered.

8. Payment methods

Payment for purchased products may be made using the payment methods made available on the website at the time of the order.

StarClean reserves the right to change, limit or suspend the available payment methods at any time.

9. Shipping and delivery

Deliveries are made to the address provided by the Customer during the order procedure.

Any delivery times indicated on the website or in the order confirmation are to be considered indicative and not essential, unless otherwise agreed in writing.

Upon delivery, the Customer is required to check:

  • the integrity of the packaging;
  • the correspondence of the number of parcels;
  • the absence of evident damage.

Any anomalies must be reported immediately to the carrier and notified to StarClean as soon as possible.

10. Right of withdrawal

If the Customer is purchasing as a consumer, they have the right to withdraw from the contract within the time limits and in accordance with the procedures provided by applicable law on distance selling.

To exercise the right of withdrawal, the Customer must communicate their intention within the legal deadline, indicating at least:

  • order number or purchase document reference;
  • Customer identification details;
  • the products for which withdrawal is requested.

The products must be returned intact, unused beyond what is necessary to verify their nature and characteristics, complete with original packaging, accessories, labels and documentation.

Unless otherwise required by law, return shipping costs are borne by the Customer.

The refund will be made within the time limits provided by applicable law, after verification of the integrity of the returned products.

11. Exclusions from the right of withdrawal

The right of withdrawal may be excluded or limited in the cases provided by law, including, by way of example:

  • custom-made or personalized products;
  • sealed goods which are not suitable for return for health protection or hygiene reasons, if opened after delivery;
  • goods which are liable to deteriorate or expire rapidly;
  • products purchased by subjects who do not qualify as consumers, where the law does not provide for withdrawal rights.

12. Legal warranty

The products sold are covered by the warranties provided by applicable law.

For consumers, the legal warranty of conformity applies within the limits established by law. For professional customers, the provisions of the Italian Civil Code and any manufacturer's commercial warranties shall apply.

To receive warranty assistance, the Customer must retain proof of purchase and contact StarClean using the contact details published on the website.

13. Liability

StarClean shall not be liable for direct or indirect damages arising from:

  • improper or non-compliant use of the products;
  • failure to comply with instructions for use or safety instructions;
  • errors attributable to the Customer when entering information;
  • delays or service disruptions not directly attributable to StarClean;
  • force majeure events.

Any mandatory provisions of applicable law remain unaffected.

14. Privacy

The Customer's personal data are processed in compliance with the applicable legislation on personal data protection.

15. Commercial communications

17. Applicable law and jurisdiction

These general terms and conditions are governed by Italian law.

For any dispute, if the Customer is a consumer, the court provided by applicable law shall have jurisdiction. In all other cases, unless otherwise required by mandatory law, the Court of Turin shall have exclusive jurisdiction.

The Customer is invited to read these terms carefully before placing an order and to keep a copy of them on a durable medium.
